Sponsor & Administrator:
Certain contest or sweepstake prizes are sponsored by entities partnering with Okcoin (the “Sponsors”), as referenced in the individual terms and conditions for the specific contest or sweepstake (the “Individual Official Rules”). Where Sponsors are not specifically listed, OKCoin USA Inc. (“Okcoin”) at One Sansome Street, Suite 3500 PMB 6005, San Francisco, CA 94104, USA, serves as the Administrator for all contests and sweepstakes.
Administrator’s computer at the above location is the official time keeping device for contests and sweepstakes.
Eligibility:
Each contest or sweepstake is open to legal residents currently residing in a country served by the applicable Okcoin entity or affiliate, who are age 18+ and the age of majority in their respective jurisdiction of residence as of the date of entry. (Find out if we serve your jurisdiction here.) Participants must have a valid email address and, at minimum, temporary access to the internet as a condition of entry.
Sponsor, Administrator, their respective parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and each of their employees, officers, and directors (collectively, the “Sweepstakes Entities”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Participation constitutes participant’s full and unconditional agreement to these Individual Official Rules and to Sponsor’s and/or Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes and which Sponsor and/or Administrator may decide in Administrator’s sole discretion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
How to Enter:
Refer to Individual Official Rules for specific instructions on how to enter. Upon completion and submission of entry conditions, you will be automatically entered with one (1) entry into the contest or sweepstakes.
As an Alternate Means of Entry of Sweepstakes you may submit a form with your full name, complete mailing address, valid email address, telephone number, and the exact title of the specific sweepstake you would like to enter here.
All contest and sweepstake participants must provide all required information to be eligible to enter and win. LIMIT ONE (1) ENTRY PER PERSON, unless specifically described otherwise in the Individual Official Rules. ADDITIONAL ENTRIES MAY BE DISQUALIFIED. Automated or bulk entries or entries submitted by third parties may be disqualified. Entries must be submitted by the participant. Any attempt by any participant to obtain more than the stated number of entries by using multiple and/or different identities, forms, registrations, email addresses, logins, or any other methods will disqualify that participant’s entries.
Where sweepstakes or contests involve a qualifying social media promotion element, by participating in sweepstakes or contests, participants acknowledge and agree that they will clearly and conspicuously disclose that they are participating in the sweepstake or contest in the entry and any online sharing interaction that references the contest or sweepstake or that is used to obtain entries in connection with the sweepstake or entry. The Individual Official Rules will include a hashtag, which should be included in all social media communications sent pursuant to the sweepstake or contest. Sponsor reserves the right to disqualify any participant who does not adequately disclose his or her participation in the sweepstake or contest while engaging in any online social sharing interaction during the sweepstake or contest period.
Administrator is not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, telephone transmission problems, or garbled transmissions or miscommunications; computer or software malfunctions, or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Administrator. Administrator’s failure to enforce any term of the Individual Official Rules or these terms and conditions shall not constitute a waiver of that provision.
Winner Selection & Notification:
On the date stated in the Individual Official Rules, Administrator will determine the potential winners based on the criteria set forth in the Individual Official Rules. The potential winner(s) will be notified by email within 30 calendar days of winner determination, unless specified otherwise in the Individual Official Rules. The odds of winning will depend on the number of eligible entries received; however it should be understood that contests and sweepstakes are typically open to entries from many jurisdictions, all of whom will be competing.
Except where legally prohibited, Administrator may require potential prize winner(s) to sign and return, within seven (7) days of being notified, an Affidavit/Declaration of Eligibility, Liability & Publicity Release in order to claim their prize. Where applicable, such a requirement will be stated in the Individual Official Rules. If a potential winner cannot be contacted in person via email after the first attempt to contact them, or if they fail to sign and return the Affidavit/Declaration of Eligibility, Liability & Publicity Release or any other documentation that Administrator requires, in its sole discretion, within the required time period, or in the event that a potential winner is disqualified for any reason, Administrator will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. If Administrator is unable to determine and verify a potential winner after repeated alternate drawings or if Administrator fails to receive a sufficient number of entries to correspond to the number of prize(s) available to be awarded, Administrator reserves the right not to award all prize(s).
All potential winners are subject to verification by Administrator whose decisions are final and binding in all matters related to the contest or sweepstakes. A participant is not a winner of any prize unless and until participant’s eligibility has been verified to the Administrator’s reasonable satisfaction and the participant has been notified that verification is complete.
Prizes:
Prizes are as described in the Individual Official Rules. Limit one (1) prize per person. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Prize(s) cannot be substituted, assigned, transferred, or redeemed for cash; however, Administrator reserves the right to make equivalent prize substitutions without prior notice. Administrator will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in the Individual Official Rules is available to be won. If, by reason of a print or other error, more prizes are claimed than the number set forth in the Individual Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available.
Disqualifications:
WARNING: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH SWEEPSTAKES CONTESTS PROVIDED BY ADMINISTRATOR OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR CONTESTS MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Administrator reserves the right to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website associated with the contest or sweepstakes, and/or the legitimate operation of the contest or sweepstakes; to violate these terms and conditions or the Individual Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
Modifications, Cancellations & Suspensions:
Administrator reserves the right to cancel, suspend and/or modify the contest or sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the contest or sweepstakes, as determined by Administrator. If, for any reason, the contest or sweepstakes cannot be run as planned, Administrator may disqualify any suspect entries and (a) suspend the contest or sweepstakes and modify the contest or sweepstakes to address the impairment, then resume the contest or sweepstakes in a manner that best conforms to the spirit of these terms and conditions and the Individual Official Rules; and/or (b) award the prize based on set judging criteria from among the eligible, non-suspect entries received up to the time of the impairment.
Disputes:
All contests and sweepstakes conducted by Administrator are governed by the laws of the United States.
LIMITATIONS OF LIABILITY AND RELEASES:
PUBLICITY: BY PARTICIPATING IN CONTESTS OR SWEEPSTAKES, PARTICIPANT AGREES THAT ADMINISTRATOR AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS,LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING PARTNERS, WEBSITE PROVIDERS, WEBMASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PARTICIPANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THE CONTEST OR SWEEPSTAKES OR IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR PRIZE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THE CONTEST OR SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, PANDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with contests or sweepstakes or any prize awarded shall be resolved exclusively through binding arbitration governed by the Federal Arbitration Act and administered by JAMS (see www.jamsadr.com). The JAMS arbitration shall be conducted in San Francisco, California (or any JAMS Resolution Center which participant and Administrator or Sponsor agree) before a single JAMS arbitrator, who shall be a retired judicial officer. Participant shall split the JAMS arbitrator fees and expenses equally with Administrator or Sponsor (as the case may be). The JAMS Streamlined Arbitration Rules & Procedures, as modified by this Agreement, shall apply. Dispositive motions will be allowed, and the arbitrator must follow this Agreement. Participant agrees and understands that, absent this mandatory arbitration provision, the parties would have the right to sue in court and have a jury trial, and further understands that, in some instances, the costs of arbitration could exceed the costs of litigation, and that the right to discovery may be more limited in arbitration than in court. If arbitration before JAMS is unavailable or impossible for any valid reason, the such arbitration will be conducted by, and according to the rules and regulations then in effect of, the American Arbitration Association (AAA); (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest or sweepstake, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions or the Individual Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California.
TO THE EXTENT PERMISSIBLE BY LAW, ALL CLAIMS MUST BE BROUGHT IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE ACTION OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PARTICIPANT’S CLAIMS OR ENGAGE IN ANY CLASS ARBITRATION. PARTICIPANT ACKNOWLEDGES THAT, BY ENTERING INTO THESE TERMS, PARTICIPANT IS WAIVING THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.
